Terms of Service

1. Acceptance of Terms

By creating an account on, accessing, or using Dance Alive's streaming services at membership.dancealive.com (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not create an account or use the Services. These Terms apply to all visitors, registered users, and subscribers.

You must be at least 18 years old to create an account. Users under 18 may use the Services only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on their behalf.

2. Description of Services

Dance Alive provides on-demand streaming access to somatic movement, meditation, and leadership content. The Services include video classes, audio recordings, written materials, and related educational resources. Content is delivered via a third-party video platform (Vimeo) and accessed through your browser. The Services do not include in-person classes, live workshops, or one-to-one coaching, which are offered separately at dancealive.com under different terms.

We may add, modify, suspend, or discontinue features at any time without notice. We may also remove specific videos or content from the catalog at our sole discretion.

The Services include automated, personalized content recommendations based on your account activity. How these recommendations work and how we use your information for them is described in our Privacy Policy.

3. Accounts and Authentication

Account creation requires authentication through Mindbody, our membership management system. By signing up, you authorize Dance Alive to access basic profile information from Mindbody (name, email, membership status) to verify your eligibility for the Services. You are responsible for:

  • Maintaining the confidentiality of your Mindbody credentials
  • All activity under your account, whether authorized by you or not
  • Providing accurate, current, and complete information
  • Notifying us promptly of any unauthorized use of your account

You may not share your account, allow others to use it, or use anyone else's account. Each account is for a single user.

4. Membership Plans

Access to the full content catalog requires a paid subscription. Dance Alive offers tiered plans — for example, Movement, Meditation, or All Access — at monthly or yearly billing cadence. Plan options, scope, pricing, and any free-trial offer are presented at signup and may change from time to time. The plan and price you accept at the time of purchase are the terms that apply to you for that billing cycle.

Payments are processed by Stripe. By providing payment information, you authorize Dance Alive (through Stripe) to charge your payment method for all fees you incur, including recurring subscription charges, until you cancel.

5. Free Trials

We may offer a free trial period for new subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the rate disclosed at signup, and we will charge the payment method you provided. You can cancel at any time during the trial by following the cancellation process in your account settings or by contacting us at legal@dancealive.com. The date your trial converts is visible in your account settings, and we will send a reminder a few days before that date.

6. Billing and Auto-Renewal

Your subscription will automatically renew at the end of each billing cycle (monthly or yearly, depending on your plan) until you cancel. By subscribing, you authorize us, through Stripe, to charge your payment method for the renewal amount at the start of each new cycle. The amount charged will reflect any applicable taxes and any price changes we have notified you about in advance.

If your payment method is declined, Stripe will retry the charge automatically over several days, and we will email you with a link to update your payment method. If we are unable to collect payment after a reasonable retry period, your access to paid features will be suspended and your subscription may be canceled.

7. Plan Changes (Upgrades and Downgrades)

You may change your plan at any time in your account settings:

  • Upgrades take effect immediately. Stripe will issue a prorated charge for the remainder of the current billing cycle, and the new plan's rate applies from that point forward.
  • Downgrades take effect at the end of your current billing cycle. You retain access to your current plan's features until the cycle ends; the new lower-tier plan begins at the next renewal.
  • Changing billing cadence (monthly ↔ yearly) takes effect at the next renewal.

8. Refund Policy

All sales are final. We do not provide refunds, partial refunds, or credits for:

  • Unused portions of a paid period after cancellation
  • Account closure mid-cycle
  • Periods during which you did not use the Services
  • Personal technical issues (your internet, browser, device, or network)
  • Content removed from the catalog after your purchase, where substitute content of comparable scope remains available

We may, at our sole discretion, issue refunds or credits in exceptional circumstances such as billing errors on our part, prolonged Service-wide outages, or documented hardship. Requests are evaluated case-by-case, and the issuance of one credit or refund does not establish a precedent for others.

9. Cancellation

You may cancel your subscription at any time in your account settings, or by emailing legal@dancealive.com from your account email address. Cancellation takes effect at the end of your current billing cycle — you retain access to paid features until that date and are not charged for the next cycle. There is no cancellation fee.

10. Taxes

Prices shown at checkout do not include taxes unless explicitly stated. Where required by law, sales tax, VAT, GST, or equivalent will be added at the time of payment. You are responsible for any taxes that apply to your subscription based on your billing address.

11. Content Availability and Technical Requirements

Dance Alive curates and updates the streaming catalog continuously. We add new content regularly and may remove content for licensing, quality, or curatorial reasons. We do not guarantee that any specific video or class will remain available indefinitely. Your subscription is for access to the catalog as it exists from time to time, not to any specific piece of content.

The Services require a modern web browser, a stable internet connection, and sufficient bandwidth for video streaming. You are responsible for your own equipment, software, internet service, and network configuration. We are not responsible for, and will not issue refunds for, problems caused by your local environment.

12. Content License and Restrictions

Subject to these Terms and your payment of all applicable fees, Dance Alive grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the content on the Services for your own personal, non-commercial use. This license is conditional on your compliance with these Terms.

You may not:

  • Copy, reproduce, download, record, stream-rip, mirror, or otherwise capture the content
  • Distribute, publish, broadcast, perform publicly, or display any content
  • Modify, translate, adapt, or create derivative works from the content
  • Remove, alter, or obscure any copyright, trademark, or proprietary notice
  • Use the content for any commercial, instructional, or for-profit purpose
  • Reverse-engineer or attempt to extract the source code of the Services
  • Use bots, scrapers, or other automated means to access the Services
  • Circumvent any access controls, rate limits, or technical protection measures
  • Share your account credentials or allow others to use your account

13. Intellectual Property

All content available through the Services — including videos, audio, text, choreography, images, music, design elements, software, and the Dance Alive name and logo — is owned by Dance Alive Studios LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The choreography and movement sequences taught through the Services are the proprietary work of the facilitators and are licensed to Dance Alive Studios LLC.

Trademark notice: "Dance Alive," the Dance Alive logo, and related marks are trademarks of Dance Alive Studios LLC. You may not use these marks without our prior written consent.

14. User Conduct

You agree not to:

  • Violate any applicable law, regulation, or these Terms
  • Infringe the intellectual property, privacy, or other rights of any third party
  • Harass, threaten, defame, or impersonate any person, including Dance Alive staff and other users
  • Upload, transmit, or distribute any material containing software viruses or harmful code
  • Interfere with or disrupt the Services or the servers and networks connected to the Services
  • Attempt to gain unauthorized access to any portion of the Services, other accounts, or any related systems
  • Use the Services to send unsolicited communications, advertisements, or spam

We reserve the right to suspend or terminate your account for violations of these Terms or for conduct that we reasonably determine to be inappropriate.

15. Health and Safety

The Services involve physical movement. Before beginning any practice through Dance Alive, you should consult your physician, particularly if you have any medical condition, are pregnant, are recovering from injury or surgery, or have not exercised recently. See our Disclaimer for additional important information.

You participate in the Services at your own risk. You are responsible for ensuring a safe practice environment (adequate space, sound flooring, removal of hazards). Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom that concerns you.

16. Accessibility

Dance Alive is committed to providing an accessible streaming experience. We aim to meet WCAG 2.2 AA standards. If you experience an accessibility barrier or need an accommodation, contact legal@dancealive.com and we will work with you in good faith to address it. Accommodations that fundamentally alter the nature of the Services or impose undue burden may not be available; we will discuss alternatives where possible.

17. Third-Party Services

The Services rely on third-party providers to function. Your use of the Services is also subject to the terms and policies of these providers, including but not limited to:

  • Mindbody — authentication and membership management
  • Stripe — payment processing
  • Vimeo — video streaming and delivery

We are not responsible for the acts, omissions, or policies of third-party providers. Disruptions or failures of these services may affect your access to the Services.

18. Privacy

Your use of the Services is governed by our Privacy Policy, which describes how we collect, use, and share your information.

19. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the maximum extent permitted by law, Dance Alive disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, nor that any defects will be corrected.

20. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Dance Alive, its officers, directors, employees, contractors, facilitators, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenue, data, use, goodwill, or other intangible losses — arising out of or in connection with your access to or use of the Services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising out of or relating to these Terms or the Services is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To that extent, the above limitations may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless Dance Alive and its officers, directors, employees, contractors, facilitators, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit, post, or transmit through the Services.

22. Dispute Resolution; Arbitration; Class Waiver

You and Dance Alive agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Dance Alive (each, a "Dispute") will be resolved through binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules. The arbitration will be conducted in Los Angeles, California, or, at your election, by telephone or video conference. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. You and Dance Alive agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Small claims exception. Either party may bring an individual action in small claims court for disputes within that court's jurisdiction, in lieu of arbitration.

Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@dancealive.com within thirty (30) days of accepting these Terms.

23. Governing Law

These Terms and any Dispute are governed by the laws of the State of California, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

24. Termination

You may stop using the Services and cancel your subscription at any time as described in Section 9 (Cancellation). We may suspend or terminate your access at any time, with or without cause, with or without notice, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use the Services ends immediately. Provisions of these Terms that by their nature should survive (including Sections 12, 13, 19-22, and this Section 24) will survive termination.

25. Changes to These Terms

We may revise these Terms from time to time. We will post the revised Terms on the Services with an updated effective date and notify you by email or in-app notice when changes are material. Your continued use of the Services after the effective date of the revised Terms constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Services.

26. Miscellaneous

Entire Agreement. These Terms, together with the documents referenced herein (including the Privacy Policy and Disclaimer), constitute the entire agreement between you and Dance Alive concerning the Services.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may freely assign these Terms.

Force Majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, governmental action, infrastructure outages, or labor disputes.

Electronic Communications. By using the Services, you consent to receive communications from us electronically, including via email and in-app notices. Electronic communications satisfy any legal requirement that such communications be in writing.
